Who operates Enishio

Enishio is a product of SHAOULA LLC. SHAOULA LLC is the operator of this service and the entity responsible for the practices described in this policy.

Agreeing to these terms

These Terms of Service are the agreement between you and SHAOULA LLC, doing business as Enishio, for your use of the Enishio service. By creating an account or otherwise using Enishio, you agree to these terms. If you don't agree, don't use the service.

These terms work alongside our other policies, which are part of this agreement by reference: the Privacy Policy (how we handle your information), the Community Guidelines (day-to-day rules for how people treat each other and what content is allowed), and Payments & Billing (how coins, gifts, unlocks, and creator earnings work once they launch). Where this document and one of those disagree on a specific point, the more specific policy controls for that point.

Who can use Enishio

You must be at least 13 years old to create an account. Signup asks for your date of birth as a neutral field, with no default or suggested answer, and we rely on what you tell us. If we later learn an account belongs to someone under 13, we'll close it.

Turning on earning — receiving coins for gifts, chapter unlocks, or ad revenue — requires you to be 18 or older and to accept our creator terms at the moment you turn it on. There's no path for a parent, guardian, or anyone else to earn on a minor's behalf; money only ever goes to the person who earned it, checked against their own identity at payout. Your account

You're responsible for the activity on your account and for keeping your login credentials to yourself. Tell us right away if you think someone else has access to your account.

Give us accurate information when you sign up, and keep your profile honest — no impersonating another person or pretending to be someone you're not.

Your content, and the license you give us

You own what you create — your stories, chapters, characters, comments, and everything else you post. Creating an account and publishing on Enishio doesn't transfer any of that ownership to us.

To make the service work, you grant SHAOULA LLC a non-exclusive, worldwide, royalty-free license to host, store, display, reformat (for example, for different screen sizes), and distribute your content, and to feature it when we promote Enishio — on the site, in the app, or in our own marketing. This license exists only to run and showcase the platform. It's non-exclusive, so you're always free to publish, license, or sell your work anywhere else, at the same time, on any terms you like.

This license ends when you remove the content or delete your account, except for two narrow cases: short-term backups we haven't purged yet, and copies other users already saved through the normal use of the service before you took it down.

We will never use your stories, characters, or other content to train a generative AI model. That's an absolute rule, not a default we might change with a settings toggle.

You're responsible for what you post. You need to own it, or have the rights and permissions to post it, before it goes up — don't post someone else's copyrighted work without their permission. See "Copyright and the DMCA" below for what happens if you do, on either side of that.

You keep your moral rights, including being credited as the author of your own work wherever we display it.

Our content and branding

Everything about the Enishio service that isn't your content — our name, logo, design, and the underlying software — belongs to SHAOULA LLC or our licensors. Using the service doesn't give you any ownership of it, and you can't copy, modify, or reverse-engineer it, or use our branding, without our written permission.

What you can't do

Beyond the day-to-day conduct rules in our Community Guidelines, you agree not to:

• Post anything sexual involving a minor, or that endangers a minor in any way — a zero-tolerance rule, enforced immediately, and reported where the law requires it.
• Post sexual or explicit content of any kind, about characters of any age. Enishio doesn't have an adult tier or an age-gated mode; the rule is the same for every user, every story.
• Harass, threaten, or target another person; post hate speech; or share someone else's private information without their consent.
• Post content that infringes someone else's copyright, trademark, or other rights, or that's illegal to post.
• Impersonate another person, or misrepresent your affiliation with any person or organization, including us.
• Interfere with the service — attempting to bypass security, scraping content at scale, introducing malware, or disrupting other users' access.
• Use the coin economy, gifting, or earning features fraudulently, including chargeback abuse or creating multiple accounts to get around a suspension.
• Use Enishio to train, fine-tune, or build a machine-learning or AI model on content you don't have the rights to use that way.

Reporting and enforcement

Every story, chapter, character, comment, and profile has a Report button. Reports go to a staff moderation queue, not a black hole — we review them and act, up to and including removing content or suspending or closing an account.

We can remove content or suspend or terminate an account for violating these terms, our Community Guidelines, or the law, with or without notice, depending on the severity. For anything short of a zero-tolerance violation, we'll generally try to warn first.

Copyright and the DMCA

We respond to clear notices of alleged copyright infringement in line with the Digital Millennium Copyright Act. If you believe something on Enishio infringes your copyright, send our designated agent a written notice including:

• A physical or electronic signature of the copyright owner or someone authorized to act for them.
• Identification of the copyrighted work you claim is infringed.
• Identification of the material you claim is infringing, and where it is on Enishio.
• Your contact information — address, phone number, and email.
• A statement that you have a good-faith belief the use isn't authorized by the copyright owner, its agent, or the law.
• A statement, made under penalty of perjury, that the notice is accurate and that you're the copyright owner or authorized to act for them.

Counter-notification

If we removed your content because of a copyright notice and you believe it was a mistake or misidentification, you can send our designated agent a counter-notice with your name, address, and phone number; identification of the removed material and where it was; a statement, under penalty of perjury, that you have a good-faith belief the material was removed by mistake; and a statement consenting to the jurisdiction of the federal court in your district (or, if you're outside the US, any district where we're found), accepting service of process from whoever sent the original notice.

If a valid counter-notice comes in, we'll tell the person who sent the original notice. Unless they tell us they've filed a court action within 10 business days, we may restore the content.

Repeat infringers, and our designated agent

We terminate the accounts of repeat copyright infringers in appropriate circumstances.

Payments, coins, and earnings

Enishio doesn't sell anything yet — see Payments & Billing for how coins, gifts, chapter unlocks, subscriptions, and creator earnings will work once they do, including our refund policy and the revenue splits we commit to.

One protection worth stating here directly: we will never treat a refund as a debt you owe us. If a refund reverses coins you've already spent, we recover what's genuinely still unspent and, where we can, undo the specific purchase it funded — we don't put your account in the negative, and we don't refer it to collections. Repeated fraudulent refunds can get purchasing suspended on an account, the same as any other abuse of the service.

Ending your access

You can delete your account any time from Settings — see Data Protection & Your Rights for exactly what that does, and the one case we ask you to handle first (handing off a community you founded, if it has other members).

We can suspend or terminate your access for violating these terms or our guidelines, or to comply with the law. Where we can, we'll tell you why.

Sections that by their nature should survive the end of your access do — including your content-license grant for content you haven't removed, any payment obligations already incurred, and the disclaimers, liability limits, and dispute-resolution terms below.

The service is provided "as is"

We work to keep Enishio reliable, but we don't promise it'll be uninterrupted, error-free, or available every moment. To the extent the law allows, Enishio is provided "as is" and "as available," without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.

Enishio is an interactive service that hosts content our users create. We don't review everything before it's posted, and we don't endorse or vouch for the accuracy, legality, or quality of any user's story, comment, or post. Your interactions with other users are your own responsibility.

Limitation of liability

To the extent the law allows, SHAOULA LLC won't be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising from your use of Enishio, even if we've been told these were possible.

Our total liability for any claim relating to Enishio is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) one hundred US dollars. Some states don't allow limiting certain warranties or damages, so parts of this section may not apply to you — where that's the case, only what the law allows applies.

You'll cover us for your own violations

If a claim arises from your content, your violation of these terms, or your violation of someone else's rights, you agree to defend and cover SHAOULA LLC against that claim, including reasonable legal fees, to the extent it's caused by something you did rather than something we did.

Resolving a disagreement

Most disagreements can be sorted out directly — email us at [email protected] first, and give us 30 days to work it out with you before starting a formal proceeding of any kind.

If that doesn't resolve it, you and we agree to resolve any claim through binding, individual arbitration under the American Arbitration Association's Consumer Arbitration Rules, rather than in court — except that either side can bring an individual claim in small claims court instead, if it qualifies. There's no judge or jury in arbitration, and court review of the result is limited.

Claims are brought individually, not as a class, consolidated, or representative action, and an arbitrator can't combine more than one person's claims without everyone's consent. If a court decides this class-action waiver isn't enforceable for a particular claim, that claim — and only that claim — goes to court instead of arbitration, and the rest of this section still applies to everything else.

You can decline this section entirely: email [email protected] within 30 days of creating your account, from the email address on the account, saying you opt out of arbitration. If you do, disputes between us go to the state or federal courts located in New Mexico instead, and nothing else about these terms changes.

Nothing here limits either side's right to seek an injunction in court to protect intellectual property or to stop ongoing abuse of the service.

Governing law, and using Enishio from outside the US

These terms are governed by the laws of the State of New Mexico and applicable US federal law, without regard to conflict-of-laws rules. Where the arbitration section above doesn't apply, the state and federal courts located in New Mexico have exclusive jurisdiction, and you consent to it.

Enishio is designed for, and directed at, people in the United States. If you access it from somewhere else, you're doing so on your own initiative, and you're responsible for following the laws that apply to you there. We don't represent that Enishio is appropriate, legal, or available for use in every country.

Changes to these terms

We can update these terms as the service changes. We'll post the update here with a new "last updated" date, and for a material change — anything that meaningfully reduces your rights — we'll give notice before it takes effect. Continuing to use Enishio after a change takes effect means you accept it.

A few last things

If any part of these terms turns out to be unenforceable, the rest still stands. If we don't act on a violation right away, that's not us giving up the right to act on it later. You can't transfer your rights or obligations under these terms to someone else; we can, if Enishio is acquired or restructured, as long as your rights under this agreement don't get smaller because of it.

These terms, together with the Privacy Policy, Community Guidelines, and Payments & Billing, are the whole agreement between you and us about using Enishio, and replace any earlier version of it.
